The Baha’i Community of Canada Website (“bahai.ca”) is an information and communications service (the “Website”). Access and use of this Website is governed by the terms and conditions provided below in the User Agreement. Please read the User Agreement carefully.

The Website is provided on an “as-is” and “as-available” basis. This User Agreement is subject to change without notice. The Baha’i Community of Canada makes no warranties or representations that the Website, including its content, information, or other material available through the Website, will be provided on an uninterrupted, timely, secure or error-free basis.

Limitation of Liability

Under no circumstances will The Baha’i Community of Canada be liable for any damages relating directly or indirectly to any action or inaction based on the content, information, products or services or other material available through the Website. The Baha’i Community of Canada will not be responsible for any damages or losses related to, the accuracy, currency or completeness of the content, information, or other material obtained through the Website.

Indemnification

You agree to indemnify, defend and hold harmless The Baha’i Community of Canada, its affiliates, its governing board, officers, agents, employees, partners and suppliers from any liabilities, losses, claims, demands, and expenses (including reasonable lawyer’s fees) related to (a) your use of the Website; or (b) violations of these Terms of Use.

Intellectual Property

All material on this website, including but not limited to, text, photographs, images, illustrations, maps, audio clips, and video clips (“Content”) is protected by copyrights, trademarks, and other intellectual property rights. The Bahá'í Community of Canada retains full legal protection for its Content under all applicable national and international laws.

All copyright, trademarks, design, rights, and other intellectual property rights (registered and unregistered) in and on the Website and in the Content belong to The Baha’i Community of Canada and/or to third parties. The Baha’i Community of Canada reserves all of its rights in the Content and the Website. Nothing in these Terms of Use grant you a right or licence to use any trademark, design, or copyright owned or controlled by The Baha’i Community of Canada or any third party except as expressly provided in the Terms of Use.

The Baha’i Community of Canada’s logo, “The Baha’i Community of Canada”, “Baha’i Canada”, and “Canadian Baha’i News Service,” are all trademarks used by The Baha’i Community of Canada under licence.

The names of all other products and services mentioned on The Baha’i Community of Canada’s Website are the trademarks or trade-names of their respective owners. The display of trademarks or trade-names on this Website does not convey or create any licence or other rights in these marks or names. You may not use The Baha’i Community of Canada’s trademarks without the prior written consent of The Baha’i Community of Canada.

Limited Use

The Baha’i Community of Canada grants you a limited licence to download and display on your computer monitor, or hard copy prints, the Website’s content, for non-commercial, personal or educational purposes only, providing that the Website content is not modified and that the Website’s copyright statement and this limited licence are included with, and displayed on, each printed copy of such content. The following limitations apply to the use of the Website:

You may not:

  • use the Website’s content for commercial purposes;
  • include the Website’s content with any product or service that you or your agents create or distribute, including software or other digital products; and
  • display the Website’s content on any other website or make available the Website’s content on any file server.

Nothing contained in the licence granted under the limited use clause shall be construed as conferring any right under any copyright of The Baha’i Community of Canada or any other person who owns the copyright.

Any reproduction, modification, publication, transmission, transfer, sale, distribution, display or exploitation of the information, in any form or by any means, or its storage in a retrieval system, whether in whole or in part, without the express written permission of the Baha’i Community of Canada is prohibited.

The Website may provide links to other Internet sites. The Baha’i Community of Canada has no control over such sites. The Baha’i Community of Canada does not endorse nor is it responsible for, any such sites or the information, material, products or services contained on or accessible through those other Internet sites.

Termination

The Baha’i Community of Canada may at its sole discretion, with or without notice, suspend or terminate your use of the Website for any reason, including a violation of the terms of the User Agreement. The Baha’i Community of Canada may also prevent you from further use of the Website. The Baha’i Community of Canada will not be liable for any suspension, termination or prohibition of future access.

Governing Law

This User Agreement is governed by the law of the province of Ontario and the laws of Canada.
